Terms and Conditions

This Platform is operated and owned by PortalZero, hereinafter referred to as "PortalZero."

1. About These Terms of Use

These Terms of Use ("Terms") set forth the essential rules for the safe, transparent, and efficient use of the services provided by PortalZero.

By accessing or using our platform, you confirm your agreement with all the terms outlined in these Terms.

Other documents related to PortalZero, such as the Privacy Notice and any additional terms accepted throughout your use of the platform, are hereby incorporated into these Terms and shall be complied with for the proper utilization of our services.

2. How to Access Our Services?

To access the services, you must register on the Platform by providing your login information and confirming your awareness of the amount previously agreed with PortalZero.

The price and billing method will be defined by you at the time of contracting, based on the plans and payment methods available on the Platform. By completing your registration, you acknowledge and accept these conditions and assume full responsibility for the selected option.

If the registration is made on behalf of a legal entity, it must be completed by its legal representative, who declares to have the authority to enter into contracts on behalf of the company and assumes full responsibility for all obligations undertaken, including financial obligations, as set forth in these Terms.

3. How to Sign Up?

To register on PortalZero, you may be asked to provide the following information:

  • Name;
  • Last Name (optional);
  • Phone;
  • Country;
  • E-mail;

By registering, you are responsible for the information and data you enter. If registering on behalf of a legal entity, you confirm that you have the authority to do so and take full responsibility for this declaration.

PortalZero does not validate, verify, or modify the data provided by the User and is not responsible for any errors, failures, losses, damages, or harm resulting from inaccurate, incomplete, outdated information or improper use of the Platform.

PortalZero holds the exclusive right to authorize the transfer or sale of access to the Platform to third parties and reserves the right to immediately revoke access for any user in violation of these terms, without entitlement to a refund.

4. Monitoring and Use of Logs

PortalZero may collect browsing data, usage metrics, and logs of actions taken on the Platform for the following purposes:

  • To ensure the proper functioning of the Platform;
  • To detect bugs or misuse;
  • To enhance functionality and improve user experience;
  • To ensure compliance with these Terms and applicable laws.

This data will be processed in line with our Privacy Policy guidelines and may be used for security measures and fraud prevention.

5. Payment, Warranties, and Cancellation

5.1. Payment

Access to the platform will only be granted once you've selected one of the available plans, confirmed your payment, and, if applicable, agreed to these Terms.

Payment is made in advance and covers the current month. The subscription will be renewed automatically unless the user states otherwise before the billing date.

Failure to pay any amounts due will not automatically terminate these Terms, but will result in the suspension of access to the platform until the outstanding payments are resolved.

The pricing for the Platform's licensing plans is based on the US dollar (USD). The final amount will be automatically converted to the local currency of the card used for the transaction, based on the exchange rate at the time of payment.

5.2. Warranty Period

We offer a 7-day warranty period. If you're not satisfied with the Platform, you can request a full refund within 7 calendar days from the date the agreement with PortalZero is formalized. After this period, refunds will no longer be available.

5.3. Cancellation

Access to the Platform is granted upon advance payment, which covers usage for 30 (thirty) calendar days from the date of purchase. If you choose to cancel your subscription during this period, you will still have access to the Platform until the end of the paid term — with no additional charges.

Cancellation will only be processed if requested through the customer service chat or the customer portal within the platform.

6. Contact Information

To reach us, please use the support chat on the Platform. If you have any questions or issues while using the Platform, our support team is ready to assist you! PortalZero may also contact you using the registered information, always prioritizing security.

7. Responsibilities

7.1. Your Conduct

Using the Platform or any associated services or tools to compromise security or disrupt the functionality of the Platform or other users' accounts is strictly prohibited. Any behavior that harms, offends, or causes damage to PortalZero or other users will not be tolerated, including, but not limited to:

  • Gaining unauthorized access to third-party accounts;
  • Creating immoral, unethical, or any content that violates legal or moral standards;
  • Using the Platform for illegal activities or in violation of these Terms;
  • Employing unauthorized methods to obtain, provide, or extract information.

The password you create during registration must be strong and unique. It is personal and non-transferable, and you are fully responsible for its security.

7.2. Misuse and Immediate Suspension

The use of the Platform in violation of these Terms may lead to the immediate suspension of access, without prior notice, particularly in cases such as:

  • Suspicion or evidence of fraud;
  • Improper use of features;
  • Violation of intellectual property;
  • Attempts to improperly access third-party data;
  • Conduct that jeopardizes the security or operation of the system.

In these cases, no refund or compensation will be provided to the User.

7.3. Limitation of Liability

PortalZero shall not be held responsible for any illegal, fraudulent, or unethical conduct by its Users. PortalZero is not liable for any losses arising from issues with the functioning of the Platform, including service unavailability, connection interruptions, system malfunctions, or technical failures. There is no guarantee of specific performance on websites, social media, or any other channels the customer uses after the solution is implemented.

8. Acceptable Use Policy

PortalZero is a traffic filtering and protection tool designed to help website owners control and optimize their traffic. The Platform is intended exclusively for lawful purposes.

You agree NOT to use the Platform for:

  • Activities that violate the terms of service of advertising platforms (such as Meta, Google, TikTok, or any other network);
  • Distribution of content that is illegal, fraudulent, misleading, or harmful;
  • Activities that infringe upon the rights of third parties, including intellectual property, privacy, or consumer rights;
  • Circumventing security measures, regulatory compliance checks, or law enforcement activities;
  • Any activity that constitutes fraud, deception, or misrepresentation to consumers;
  • Distribution of malware, phishing pages, or other malicious content.

PortalZero provides traffic filtering technology as a neutral tool. We do not monitor, review, approve, or endorse the content, offers, or landing pages used by our customers. The User is solely and entirely responsible for ensuring that their use of the Platform complies with all applicable laws, regulations, and third-party terms of service.

PortalZero reserves the right to suspend or terminate access to any account that is found to be in violation of this Acceptable Use Policy, without prior notice and without entitlement to a refund.

9. Indemnification

You agree to indemnify, defend, and hold harmless PortalZero, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to legal fees) arising from:

  • Your use or misuse of the Platform;
  • Your violation of these Terms;
  • Your violation of any applicable law, regulation, or third-party rights;
  • Any content, offers, landing pages, or campaigns created, managed, or distributed through your use of the Platform;
  • Any claims brought by advertising platforms, regulatory agencies, or third parties related to your use of the Platform.

This indemnification obligation shall survive the termination of your account and these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

PortalZero shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, regardless of whether such damages were foreseeable or whether PortalZero was advised of the possibility of such damages.

PortalZero's total aggregate liability under these Terms shall not exceed the total amount paid by you to PortalZero in the twelve (12) months immediately preceding the event giving rise to the claim.

PortalZero does not guarantee any specific results, performance, or outcomes from the use of the Platform. The effectiveness of traffic filtering depends on multiple factors outside our control, including but not limited to the configuration of your campaigns, the behavior of advertising platforms, and changes in detection algorithms.

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Data Deletion

The user can request the deletion of their personal information linked to their PortalZero account by contacting support. Once the deletion request is made, all data related to interactions will be permanently erased and cannot be recovered. Other account-related data, except for those required to fulfill tax and legal obligations, will be deleted within 90 days of the request.

12. Data Protection and Security

PortalZero values your privacy and data protection. We utilize industry-standard infrastructure with high protection standards, along with advanced encryption applied to all processed data. We also reserve the right to investigate any violations of these Terms and cooperate with the relevant authorities when necessary.

13. Intellectual Property

By using the Platform, you agree to respect the intellectual property rights of PortalZero and third parties, including all available content such as texts, images, trademarks, and logos, which may not be used without prior authorization. Any improvements or adaptations made to the Platform will remain the exclusive property of PortalZero. Unauthorized use of any protected material may lead to legal consequences.

14. Age Restriction

You must be at least 18 years of age to use the Platform. By creating an account, you confirm that you are at least 18 years old. PortalZero does not knowingly collect personal data from individuals under 18 years of age.

15. Validity and Updates

This Term will remain in effect indefinitely, as long as the Platform is active and available for use. We may update this document periodically. When updates are made, you will be notified in advance. If you do not agree with the new terms, you may choose to close your account or discontinue your use of the Platform.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from or related to these Terms or the use of the Platform shall be submitted to the courts of Maringá, State of Paraná, Brazil, to the exclusion of any other forum, however privileged it may be.

For users located outside of Brazil, these Terms shall still be governed by Brazilian law, and the parties agree to submit to the jurisdiction specified above.

17. Final Provisions

The use of PortalZero services does not establish any partnership, sponsorship, or endorsement by PortalZero of your products, content, or services. Neither party will be held liable for delays or failures caused by unforeseeable events beyond their control. If any clause is deemed invalid, the remaining clauses will remain unaffected.
